Terms of use

These terms apply to your use of Custodian, operated by Custodian Philanthropy Ltd (company number 17320219). By signing in you agree to them.

If your foundation has a signed agreement with us, that agreement takes priority where it differs from these terms.

Custodian is invite-only: accounts are created by a foundation's administrator. Keep your sign-in details to yourself and tell your administrator, or us, straight away if you think someone else has used your account. Administrators are responsible for who they invite and the roles they give them.

You agree not to:

• try to reach data belonging to another foundation, or to get round security;
• upload anything unlawful, or that you do not have the right to share;
• disrupt the service, or use automated means to overload it;
• copy or resell the service, or try to reverse engineer it.

The information a foundation puts into Custodian, or receives through it, belongs to that foundation. We use it only to provide the service, as described in our privacy policy. Foundations are responsible for having the right to collect and use the data of their applicants and grantees.

Custodian uses AI to summarise, score and check applications and reports. These are aids to a foundation's judgement, not decisions, and may be wrong. Decisions about grants, payments and people are always the foundation's own.

We work to keep Custodian available and secure, but cannot promise it will always be uninterrupted or free of errors. We improve the service regularly and may change or withdraw features, and will give foundations notice of any change that affects them significantly.

Custodian, its software and its design belong to Custodian Philanthropy Ltd. Using the service does not give you any rights in them beyond using it as these terms allow.

Nothing in these terms limits liability that cannot be limited by law. Otherwise, we are not liable for indirect or consequential loss, and our total liability is limited as set out in the foundation's agreement with us.

We may suspend access that puts the service, or other foundations' data, at risk. Your foundation's administrator can remove your access at any time, and you can remove your own account from your profile.

These terms are governed by the law of England and Wales, and its courts have exclusive jurisdiction.
